WHAT IS THE TRADEMARK?
         According to the Law of the Republic of Uzbekistan "On trademarks, service marks and appellation of origin of the goods", from September 22, 2001, the trademark and service mark is the designation registered when due hereunder serving for difference of the goods and services of one juridical and physical persons from the homogeneous goods of other legal and physical persons.
         As trademarks graphic, verbal, volumetric and other designations or their combinations in any color or color combination can be registered.

         HOW TO REGISTER THE TRADEMARK?
         In Uzbekistan the legal protection of trademark is given only after its official registration.
         The trademark can be registered on name of juridical or physical person who is carrying out enterprise activity.
         For registration of trademark it is necessary to make an application, drew up according to Rules, in the State Patent Office. After carrying out of the examination established by the law and within a month from the date of reception of the document on payment of patent fee registration of trademark is made.
         Data on registration of trademark are published in the official bulletin of Patent Office. The certificate on trademark grants out by Patent Office within a month after registration of trademark and operates within ten years from the date of application filing.
         Validity of the certificate on trademark can be prolonged under the request of the owner submitted within last year of action of the certificate, each time for ten years.

         BASES FOR REFUSAL IN REGISTRATION
         As trademarks are not registered, in particular, designations:
         - not possessing distinctive ability;
         - being the standard symbols and terms;
         - qualities used for the characteristic, quantity, property, purpose, value of the goods, and also places and time of their manufacture or selling;
         - false or capable to lead into error on the goods or its manufacturer.
