WHAT IS THE APPELLATION OF ORIGIN?

According to the Law of the Republic of Uzbekistan "On trademarks, service marks and appellation of origin of the goods» from September 22, 2001, as appellation of origin the name of the country, settlement, district or other geographical object, used for designation of the goods which special properties exclusively or are mainly defined by the characteristic environment for the given geographical object either other factors, or combination of environment and these factors admits.
Legal protection of appellation of origin is given on the basis of its registration in the Patent Office.
The appellation of origin can be registered by one either several legal or physical persons who are being that geographical object which name is used for designation of the made goods.
The person who has registered the appellation of origin, receives the right of use of it if makes the goods which special properties exclusively or are mainly defined by the characteristic environment for the given geographical object either other factors or combination of environment and these factors.
Right of use of appellation of origin can be given and to other legal or physical person being the same geographical object and making the goods with the same special properties.
Use of registered appellation of origin by the persons who are not having the certificates on the right of use to data appellation of origin even if thus the original place of an origin of the goods is underlined is not supposed, or the name is used in translation, or in combination to words "sort", "type", " in style " and so on.

HOW TO REGISTER RIGHT OF USE THE APPELLATION OF ORIGIN?

For registration is necessary to file an application in State Patent Office. After carrying out of the examination established by the law and within a month from the date of reception of the document on payment of the patent fee registration of appellation of origin is made.
The certificate on right of use the appellation of origin grants out by the Patent Office within a month after registration. The form of certificates and structure of data specified in them are established by the Patent Office.
The certificate on right of use the appellation of origin operates within ten years from the date of filing application. Term of its action can be prolonged under the request of the owner submitted within last year of its action, each time for ten years.
